
The YouTube channel ‘Gaseyeon’ has been ordered by the court to pay 10 million won for each instance of posting content related to YouTuber Tzuyang (real name Park Jeong-won).
According to the legal community on the 26th, the Seoul High Court made a partial ruling on the 24th regarding Tzuyang's appeal for an injunction against Gaseyeon and its representative Kim Se-yi to delete and prohibit posts.
The court stated, “To prevent the infringement of the creditor's honor and privacy, it is necessary to issue an indirect enforcement payment order of 10 million won for each violation when the debtors produce and post live broadcasts or videos on their YouTube channel.”
Additionally, the court emphasized, “The debtors have posted videos that expand and reproduce related allegations even after the original decision,” and “Without a separate indirect enforcement decision, there is a high likelihood that they will repeatedly post videos that violate the first-instance decision in the future.”
Previously, Gaseyeon claimed in July last year that Tzuyang was threatened by YouTuber Gyujaeok based on the fact that she had worked in an entertainment establishment in the past, and they released related recordings.
In response, Tzuyang refuted that she had no choice but to work at the establishment due to the violence and coercion from her ex-boyfriend, but Gaseyeon continued to broadcast, claiming her explanation was ‘false.’
Tzuyang filed a lawsuit against Gaseyeon and Representative Kim for defamation and violations of the Stalking Punishment Act, and requested an injunction to delete the videos.
In the first instance, only a deletion order for some videos was issued, and the request for indirect enforcement was dismissed, but the appellate court decided to impose indirect enforcement on Gaseyeon.
